CASE 1. CITIZENS EU

 

 

We summarize the cases in which Citizens of a Member State of the European Union, of a State party to the Agreement on the European Economic Area and Switzerland who meet the requirements described will have the right to reside in Spain on a permanent basis.

Accredit one of the following conditions:

ASSUMPTION 1: having legally resided in Spain for a continuous period of five years. For these purposes, legal residence will be considered that in which, during the last five years, the person proves:

     Employee in Spain, or

    Have been a self-employed worker in Spain, or

     Sufficient financial resources

     Have been a student and have been enrolled in a public or private center

    Be a national of a Member State, family member accompanying a citizen of the Union or the European Economic Area, who meets one of the above conditions.

 

  2: having been a self-employed worker or an employee and having ceased their activity due to having reached the age established in Spanish legislation for accessing retirement with the right to a pension.

ASSUMPTION 3: have been an employee and have ceased to occupy the paid activity due to early retirement, when they have carried out their activity in Spain for at least the last twelve months and have resided in Spain continuously for more than three years.

 4: having been a self-employed or employed worker and having ceased to carry out their activity as a result of permanent disability, having resided in Spain for more than two years without interruption.

ASSUMPTION 5: having been a self-employed or employed worker and after three consecutive years of continuous activity and residence in Spain, you carry out your activity in another Member State, maintaining your residence in Spain, returning to Spanish territory daily or, at least, once a week.

 6: being a national of a State of the Union and family member (spouse or registered de facto partner, direct descendant or of their spouse or partner under 21 years of age or incapable or older than that age who lives in their care, or direct ascendant or of their spouse or registered partner who lives in their charge) of the self-employed worker or employee who acquires permanent residence by meeting the requirements of ASSUMPTIONS 2, 3, 4 or 5 mentioned.

CASE 2. CITIZENS OF OTHER STATES

 

Citizens of other States

If you are a citizen of another country (not a member of the European Union) you can also come to Spain to reside if you meet certain requirements. Find out from our lawyers about the conditions for entry, stay, studies, residence, family reunification, residence and work and other authorisations that foreign citizens from third countries can obtain, without prejudice to the provisions of special laws and international treaties to which Spain is a party.

– Stay in Spain. Stay in Spain for a period of no more than 90 days (except in the case of studies, non-labour practices or volunteering).

– Temporary residence. Residence in Spain without employment.

– Family reunification.

– Residence and work in Spain.

– Students, stays for research or training, student mobility, non-work placements and voluntary work. Information on residence for foreigners who wish to carry out any of these activities in Spain and for their family members.

– Residence authorisations for exceptional circumstances (cases of roots, humanitarian reasons, minors under guardianship who reach the age of majority without authorisation and authorisations for women who are victims of gender violence).

– Temporary residence for foreigners who have voluntarily returned to their country. Authorisation for residence or residence and work that foreigners who have returned to their country of origin voluntarily or on the basis of a voluntary return programme may obtain, once the period of validity of the non-return commitment has expired.

– Modifying an authorisation. Information on modifications of authorisations.

– Long-term residence. Authorisation to reside in Spain indefinitely and to work under the same conditions as Spaniards.

– Return authorisation. Allows you to leave Spain and return within a period of no more than 90 days.

– Minors. Information on procedures related to foreign minors.

– Renewal of authorisations.

– Collective management of hiring at origin. Collective management allows the hiring of workers who are not in Spain and do not reside in Spain, selected in their countries of origin based on generic offers presented by employers.

– Youth mobility agreements.

 La movilidad urbana en España y en Europa

 La movilidad urbana  en España y en Europa

Las nuevas tecnologías  han permitido un mayor desarrollo en todos su sectores. Es por eso que  no es de menos, destacar la importancia de las mismas en el sector automovilístico.

En  este post analizaremos los nuevos servicios que ofrecen tanto los coches,  las motos,  y otras alternativas de micromovilidad, como las bicis y patinetes eléctricos. 

En primer lugar, señalar que gracias al carsharing (coche compartido) se han podido obtener múltiples ventajas.

Previamente,  señalar  que se ha conseguido reducir la contaminación en las grandes ciudades. Asimismo, ha logrado descongestionar los espacios públicos ocupados por vehículos particulares. Destacamos el dato de que un coche compartido puede llegar a sustituir hasta 10 vehículos particulares. Así pues, logra impulsar un nuevo ecosistema de movilidad sostenible. 

En este novedoso sector, los primeros en lanzarse fueron Car2Go (ahora conocido como Share Now) y eMov. Al haber poca competencia en el sector otras marcas aprovecharon la ventajas del msimo. Es por ello que, surgieron otras como Zity, Wible y Drive Now. 

Cada una de estas marcas, está respaldada por grandes empresas. Por ejemplo, en el caso de Share Now, es BMW, o de eMov Citröen. 

El carsharing, se caracteriza por ofrecer un servicio de movilidad compartida al cual se accede a través de una app del móvil. El usuario solo tiene que localizar en su teléfono (smartphone) el coche más próximo y proceder a su reserva. Una vez que se ha llegado al destino deseado, se aparca el coche. El precio será más o menos flexible; dependerá de la tarifa escogida (horas, minutos y días). 

Además, apuntar que se trata de una propuesta limpia de movilidad para ciudades, como  con el caso de Madrid Central,  ya que son coches eléctricos e híbridos . 

Aunque al principio solo se encontrasen este tipo de vehículos en el centro, cada día su presencia aumenta en los barrios cercanos o periferia. 

Es por tanto que, el carsharing busca fomentar un mercado basado en un ecosistema ideal. Por ello, necesita del soporte de las políticas locales y autonómicas que lo incentiven y respalden. 

En segundo lugar, hablaremos del caso de las motos compartidas. Estas, presentan unas cualidades muy ventajosas. Son pequeñas, rápidas, no contaminan y son fáciles de aparcar. Es por ello, que el número de usuarios en las ciudades (Madrid, Barcelona y Valencia ) ha ido aumentando  cada vez más. 

Hablamos del concepto motosharing ( moto compartida)  y las principales marcas de este sector en España son las siguientes. Podemos encontrar eCooltra, Ioscoot, Coup. Muving, Acciona Movilidad  y Movo (filial de Cabify) . 

Hablaríamos en este sentido, de una mercado competitivo donde cada marca se diferencia de la otra por una serie de cualidades. 

En el caso de la eCooltra, podemos destacar que fue la marca pionera y quien más motos tiene a día de hoy (4.500 motos eléctricas). Además, esta marca se encuentra en otros países europeos como en Portugal (Lisboa) e Italia (Milán y Roma), sumando un total de 500.000 usuarios. 

En lo que respecta a Ioscoot, fue una marca que nació en la capital catalana. Se diferencia del resto por un diseño más robusto y con una pantalla de navegación en el centro. Destacaríamos la  Coup, que se caracteriza por ser estar en expansión y Muving , que es tanto una marca operadora como fabricante. Esta última se encuentra arraigada en varias ciudades como Málaga, Valencia o Zaragoza. 

En lo relativo a su funcionamiento señalamos  lo siguiente. Al igual que el carsharing, a este tipo de motos también se accede por la app del móvil. Una vez descargada, puedes elegir la moto más cercana y basta con dar al botón de “Iniciar” en la app para desbloquearla y “start” para empezar.  

Como todo servicio, se deben respetar las medidas de seguridad, como en este caso, el casco. El usuario dispondrá del casco que ofrece la empresa o si lo prefiere podrá usar el suyo propio. Los precios resultan bastante atractivos ya que las tarifas se encuentran entre los 0,19€min o 0,25€ min, en función de la marca. 

En tercer lugar, destacamos las otras alternativas de movilidad que podemos encontrar. 

Hablaríamos del caso de los patinetes y las bicicletas. Ambos contribuyen a un nuevo modelo de construcción de transporte colaborativo que deben cumplir y compartir las ciudades. 

Además, tanto las bicis como los patinetes, favorecen al ecosistema de micromovilidad urbana. 

  • En el caso de las bicis, estas, ofrecen comodidad en los recorridos de corta distancia. En España, encontramos : la BiciMad en Madrid, Bicing en Barcelona, Minibisi Valencia o Bilbao Bizi en Valencia. Estas marcas se caracterizan por  ser públicas y tener estaciones fijas donde volver a dejarlas.  

Por el contrario, encontraríamos empresas de bicis privadas como:  Mobike, Scoot o Ofo o Donkey Republic y el sistema de  “free floating” que carece de puntos fijos para dejarlas. 

Podemos señalar que al contrario de los dos servicios anteriores, en el caso de las bicis, se dan más vacíos legales, y casos de vandalismo. Este último hecho, ha derivado en que empresas privadas  (Ofo y Obike ) dejen de ofrecer sus servicios en ciudades como Madrid y Granada. 

  • Por otro lado, señalaremos el caso de los patinetes eléctricos. A pesar de ser lo más  novedosos en llegar, su presencia en las calles no pasa desapercibida.Podemos verlos en varios lugares como Madrid , Barcelona, Zaragoza, Málaga, Valencia… . En el caso de Madrid, destacaríamos que es la ciudad, que a fecha del 2019, tiene mayor número de patinetes eléctricos, como motivo de su aprobación municipal en febrero.  

La marca más notoria es Jump. Se trata del servicio de alquiler de patinetes eléctricos compartidos de Uber. Además, se posiciona como el primer operador de las 18 licencias que ha otorgado el Ayuntamiento de Madrid. 

Sin embargo, destacamos otras marcas en España que también están posicionadas en este nicho. Así pues, encontraríamos Lime, Voi, Movo, Acciona, Koko, Flash o Bolt. 

Este servicio emplea el mismo funcionamiento: se accede a él a través de una app y  sigue un proceso similar a los señalados. 

Un  dato curioso a destacar sobre los patinetes es el siguiente. La mayoría de ellos, empiezan o finalizan en una parada de metro o bus,  por lo que favorecen el transporte público. 

En definitiva, tanto lo coches, como las motos,  las bicis y los patinetes eléctricos confeccionan un modelo de negocio solidario con el medio ambiente. La clave principal es la tecnología, la cual ha permitido que se gane eficiencia adaptándose a una situación de demanda creciente. Es por ello que resulta imprescindible conocer la regulación de dicho sector y de esta manera no sentirse desamparado en este nuevo modelo de negocio.
